Terms and Conditions of Use

1. Purpose

These Terms and Conditions of Use (hereinafter "T&C") govern access to and use of the chuttt.ch platform (hereinafter "the Platform"), published by ChuTTT Sarl, a limited liability company under Swiss law, with its registered office at Avenue de Frontenex 8, 1207 Geneva, Switzerland.

The Platform is an online intermediation service connecting individuals (hereinafter "Users") with qualified professionals (hereinafter "Professionals") for the completion of projects in the areas of housing, services, transport, real estate, and other sectors.

The use of the Platform implies full and complete acceptance of these T&C.

2. Definitions

• User: any natural or legal person accessing the Platform to submit a quote request.
• Professional: any natural or legal person registered on the Platform to offer their services and respond to quote requests.
• Quote: a costed proposal issued by a Professional in response to a User's request.
• Cashback: partial reimbursement of the commission received by ChuTTT, returned to the User after signing a quote.
• Referral code: a unique code allowing a User to recommend the Platform and receive a commission on generated transactions.

3. Registration and Access

3.1 Users

Registration and quote requests are entirely free and without commitment. The User undertakes to provide accurate and up-to-date information (email, phone, project description).

3.2 Professionals

Registration as a Professional is subject to validation by the ChuTTT team. Professionals undertake to provide truthful information regarding their company, field of activity, and area of intervention.

3.3 Age Requirements

Use of the Platform is reserved for persons aged at least 18 years or with the legal capacity to contract.

4. How the Platform Works

4.1 Quote Request

The User submits a quote request by selecting a category, subcategory, and service, then describing their project, budget, and desired deadline. They receive up to 4 quotes from Professionals selected by the ChuTTT team.

4.2 Role as Intermediary

ChuTTT acts exclusively as an intermediary. The Platform does not provide any direct services. The contract for works or services is concluded directly between the User and the Professional. ChuTTT cannot be held responsible for the quality, deadlines, or execution of services provided by Professionals.

4.3 Selection of Professionals

Professionals are selected by the ChuTTT team based on criteria of quality, reliability, and match with the User's project. This selection does not constitute a guarantee or certification of the Professional's competences.

5. Cashback

5.1 Principle

When a User signs a quote obtained through the Platform, ChuTTT returns to the User 50% of the commission received from the Professional, in the form of cashback.

5.2 Trigger

The cashback is triggered upon the signing of the quote by the User. The User must submit the signed quote to ChuTTT for validation.

5.3 Use of Cashback

The cashback can be:

• Withdrawn directly to a bank account
• Accumulated in a savings account on the Platform
• Donated to a partner charity

5.4 Payment Deadline

The cashback is paid within 30 business days following validation of the signed quote by the ChuTTT team.

6. Referral Programme

6.1 Principle

Any User who has submitted a quote request can obtain a unique referral code. By sharing this code, they allow new Users to register on the Platform.

6.2 Referral Commission

When a referred person (person who used the referral code) signs a quote obtained through the Platform, the referrer receives a commission of 0.5% of the total transaction amount.

6.3 Conditions

The referral commission is paid only after validation of the quote signature by the ChuTTT team. Referrals are cumulative and have no time limit.

6.4 Abuse

ChuTTT reserves the right to suspend or cancel referral commissions in case of fraud, self-referral, or any abusive use of the system.

7. Professional Commission

Professionals pay a commission of between 5% and 10% of the signed quote amount, depending on the type of service and volume. This commission is only due when a quote is actually signed by a User. No registration or subscription fees are required.

8. User Obligations

The User undertakes to:

• Provide accurate and complete information in their quote requests
• Not use the Platform for fraudulent or illegal purposes
• Not submit fictitious or abusive requests
• Respect Professionals in their exchanges
• Report any inappropriate behaviour by a Professional to the ChuTTT team

9. Professional Obligations

The Professional undertakes to:

• Provide accurate information about their company and competences
• Issue compliant, detailed, and honest quotes
• Respect the deadlines stated in their quotes
• Pay the commission due to ChuTTT upon quote signature
• Comply with current Swiss legislation in the exercise of their activity

10. ChuTTT Liability

ChuTTT makes every effort to ensure the proper functioning of the Platform. However, ChuTTT cannot be held liable for:

• The quality or execution of services provided by Professionals
• Disputes arising between Users and Professionals
• Temporary interruptions of the Platform for maintenance or technical reasons
• Indirect damages related to the use of the Platform

In case of a dispute between a User and a Professional, ChuTTT may offer a free mediation service without being a party to the dispute.

11. Intellectual Property

All elements of the Platform (texts, images, logos, design, source code) are the exclusive property of ChuTTT Sarl or its partners. Any reproduction, representation, or exploitation, even partial, is prohibited without prior written authorisation.

12. Modification of T&C

ChuTTT reserves the right to modify these T&C at any time. Users and Professionals will be informed of any substantial modification by email or by notification on the Platform. Continued use of the Platform after modification constitutes acceptance of the new T&C.

13. Termination

The User may stop using the Platform at any time without formality. The Professional may request the deletion of their account by contacting the ChuTTT team at contact@chuttt.ch.

ChuTTT reserves the right to suspend or delete any account in case of violation of these T&C, without notice or compensation.

14. Applicable Law and Jurisdiction

These T&C are governed by Swiss law. Any dispute relating to the interpretation or execution of these T&C shall be submitted to the exclusive jurisdiction of the courts of the Canton of Geneva, Switzerland.
